Whistleblower retaliation
Early identification of adverse actions against a reporting employee — exclusion and isolation, pressure to withdraw the complaint, performance management used as a pretext, and coordination among supervisors to justify a measure. Cross-checks the temporal proximity between the report and the adverse action. Mandatory human review.
Linguistic warning signals
- instructions to exclude or isolate the person after a report
- pressure to withdraw or not formalize the complaint
- documenting performance "from now on" to build a paper trail
- coordination among supervisors to delay a measure so it "doesn't look like retaliation"
Why it matters
Whistleblower retaliation is rarely a single isolated decision — it's built in small steps that, seen individually, look like normal management: a harsher performance review, a project reassignment, exclusion from a meeting. What makes it detectable is the pattern and, above all, the temporal proximity to the original report. Whistleblower protection laws in most jurisdictions shift the burden of proof: it's the company that must show the adverse measure was unrelated to the report.
Relevant regulatory framework
- Chile — Art. 489/493 Labor Code, Ley Karin
- Brazil — Lei 13.608/2018, Lei 14.457/2022
- Mexico — LGRA Art. 64
- Argentina — Law 27.401
- Global — Dodd-Frank §922, SOX §806, EU Directive 2019/1937
Recommended action
- 1Freeze any performance management action against the reporting employee pending compliance review.
- 2Independently document whether a performance issue existed before the report.
- 3Check the temporal proximity between the report date and any proposed adverse measure.
- 4Escalate to legal before executing any decision affecting someone who recently reported.
