Why is communications monitoring a valid antitrust compliance tool in Chile?
The Fiscalía Nacional Económica (FNE) states in its Trade Associations and Competition Guide (2011) that "casual conversations about prices, quantities, and future business strategies" are collusion signals. Its Compliance Programs guide (2012) recognizes internal monitoring as a detection mechanism and, in case of infringement, as a mitigating factor in sanctions.
What conduct does vario detect and why is it illegal under the FNE?
vario detects signals of price fixing, market allocation, bid manipulation, and strategic information exchange among competitors — all per se illegal under DL 211. The FNE itself identifies the exchange of individual, current, and strategic information as the highest-risk category for anticompetitive harm.
Does antitrust compliance reduce sanctions in Chile?
Yes. The FNE recognizes compliance programs as a mitigating circumstance in case of infringement. A structured program with active detection mechanisms — such as vario — is concrete evidence of due diligence before the regulator.
Which types of companies face the highest collusion risk in Chile?
According to the FNE, trade associations are the most common collusion vector: they account for 29% of all detected cartels and 100% of cartels with 25 or more members. Companies participating in industry associations, public procurement, or concentrated markets face the highest exposure.

Is it legal for an employer to monitor corporate email in Chile?
Yes, with conditions. The CADEM case (Santiago Court of Appeals, 2018) — the leading Chilean precedent — establishes that monitoring corporate emails is lawful when there is a legitimate purpose and the measure is proportionate. Antitrust compliance qualifies as a legitimate purpose.
Does corporate email have the same protection as personal email?
No. The Consejo para la Transparencia applies a divisibility principle: communications sent using institutional resources for work-related functions carry a reduced privacy expectation compared to purely personal communications. Corporate @company.com accounts are functionally distinct from personal accounts such as Gmail or Hotmail.
What conditions must a company meet to deploy vario in Chile?
The monitoring policy must be included in the Internal Rules of Order, Hygiene, and Safety (required by DT Rulings N°2328/130 and N°3877/2019). Employees must be informed of the scope and purpose of monitoring before deployment, and the company must document the legal basis in accordance with Law 21.719.
Which data protection authority applies in Chile?
The Agencia de Protección de Datos Personales, created by Law 21.719 (December 2024). This law modernizes the Chilean framework with GDPR-aligned principles: proactive accountability, ARCO rights, and enforcement powers. vario acts as a data processor under the client's instructions as data controller.
What is the DPIA and is it recommended for Chile?
The Data Protection Impact Assessment (DPIA) is the mechanism under Law 21.719 for analyzing the risks of high-risk processing activities, such as communications monitoring.
