Why is communications monitoring a valid antitrust compliance tool in Mexico?

COFECE published the Guide on Information Exchange Among Competitors (2015) — the most detailed in LATAM — which explicitly categorizes dangerous information (individual, current, strategic) and requires internal controls to prevent it. COFECE's own compliance documentation references "monitoring mechanisms" and "compliance review" as part of corporate operations.

Privacy & data protection

Is it legal for an employer to monitor corporate email in Mexico?

Yes, with conditions. The SCJN Isolated Thesis 2030393 (2024) expressly establishes that the right to privacy of private communications (Art. 16 CPEUM) does not extend to corporate email accounts provided by the employer. Monitoring must be reasonable, proportionate, and accompanied by prior notice.

Does corporate email have the same protection as personal email?

No. SCJN Thesis 2030393 (2024) explicitly distinguishes corporate email — a professional activity tool — from personal email. vario operates exclusively on @company.com accounts; personal accounts are outside its scope.

What conditions must a company meet to deploy vario in Mexico?

Every company with 20 or more employees must include the monitoring policy in the Internal Work Regulations (LFT). A privacy notice compliant with the new LFPDPPP 2025 is mandatory, as is informed employee consent and likely a DPIA. Mexico also requires documenting AI governance compliance under the LFPDPPP 2025.

Which data protection authority applies in Mexico?

Since March 2025, the Ministry of Anti-Corruption and Good Governance, which replaced INAI after the new LFPDPPP 2025. The same authority that fights corruption now supervises data protection — which may translate into a favorable view of monitoring as a legitimate compliance tool.

What is AI governance under the LFPDPPP 2025 and how does it affect vario?
